1. 總覽 Overview
按揭道有限公司（「本公司」）致力保護及保障個人資料。因此，本公司之政策為確保其就有關收集、使用、轉移、保存及查閱個人資料的政策及常規符合香港法例第486章《個人資料（私隱）條例》（「該條例」）的規定。
MORTGAGEOLOGY LIMITED (the “Company”) is committed to protecting and safeguarding personal data. It is therefore the Company’s policy to ensure that its policies and practices relating to the collection, use, transfer, retention of and access to personal data comply with the requirements of the Personal Data (Privacy) Ordinance (Cap. 486 of the Laws of Hong Kong) (the “Ordinance”).
2. 所收集的個人資料類別 Types of Personal Data Collected
為達至本公司能提供按揭貸款轉介及地產代理服務的目的，顧客可能被要求提供其個人資料予本公司，而該等個人資料包括但不限於姓名、聯絡資料（包括但不限於電話號碼、傳真號碼、電郵及／或通訊地址）、身份證明文件號碼及可能載有顧客的個人資料的文件副本，例如臨時買賣合約（按下列第6條所列之機構或人士（「第三方」）之要求）。若顧客未能提供該等個人資料，本公司可能因此而未能提供按揭貸款轉介及相關服務。
In order for the Company to provide mortgage loan referral and estate agency services, customers may be requested to provide their personal data to the Company, including but not limited to their name, contact information (including but not limited to telephone number, fax number, email and/or correspondence address), identity document number, and copies of documents which may contain the customer’s personal data, such as provisional sale and purchase agreements (as required by the institutions or persons set out in Clause 6 below (the “Third Parties”)). If a customer fails to provide such personal data, the Company may be unable to provide mortgage loan referral and related services.
3. 個人資料的使用 Use of Personal Data
顧客所提供的個人資料可能被本公司用於以下用途：
- 提供是次按揭貸款轉介服務；
- 直接促銷本公司日後之按揭貸款轉介及相關服務如地產代理服務、相關獎賞及／或相關優惠計劃及／或活動（「該等服務」）；
- 轉移至下列第6條所列之機構或人士（「第三方」）用於是次按揭貸款轉介服務與直接促銷該等服務。
Personal data provided by customers may be used by the Company for the following purposes:
- providing the present mortgage loan referral service;
- direct marketing of the Company’s future mortgage loan referral and related services, such as estate agency services, related rewards and/or related benefit schemes and/or activities (the “Services”); and
- transfer to the institutions or persons set out in Clause 6 below (the “Third Parties”) for the present mortgage loan referral service and for direct marketing of the Services.
4. 使用個人資料作直接促銷 Use of Personal Data in Direct Marketing
本公司擬使用顧客的姓名及聯絡資料（包括電話號碼、傳真號碼、電郵及／或通訊地址）作直接促銷本公司日後之按揭貸款轉介服務，以及上列第3條所列之該等服務。
The Company intends to use customers’ names and contact information (including telephone number, fax number, email and/or correspondence address) for direct marketing of the Company’s future mortgage loan referral services and the Services set out in Clause 3 above.
5. 轉移個人資料作直接促銷 Transfer of Personal Data for Direct Marketing
本公司擬轉移顧客的姓名及聯絡資料（包括電話號碼、傳真號碼、電郵及／或通訊地址）至下列第6條所列之機構或人士（「第三方」）用作直接促銷按揭貸款轉介服務以及上列第3條所列之該等服務，而本公司或會因此而獲得利益。
The Company intends to transfer customers’ names and contact information (including telephone number, fax number, email and/or correspondence address) to the institutions or persons set out in Clause 6 below (the “Third Parties”) for direct marketing of mortgage loan referral services and the Services set out in Clause 3 above, and the Company may receive benefits as a result.
6. 個人資料的轉移 Transfer of Personal Data
由本公司所管有的顧客個人資料可能會被轉移至以下第三方：
- 銀行及相關金融機構；
- 政府機構（如地產代理監管局）、監管機構及／或其他合法的機關；
- 法院、審裁處及／或參與法律程序的各方。
Customers’ personal data held by the Company may be transferred to the following Third Parties:
- banks and related financial institutions;
- government bodies (such as the Estate Agents Authority), regulatory bodies and/or other lawful authorities; and
- courts, tribunals and/or parties involved in legal proceedings.
7. 要求停止直接促銷 Request to Cease Direct Marketing
根據該條例，即使顧客已同意本公司使用及／或轉移其個人資料至第三方作直接促銷，顧客仍有權隨時要求本公司在不收費的情況下停止使用及／或轉移其個人資料至第三方作直接促銷。顧客可致函 info@mortgageology.com.hk 或 5/F, Chung Nam House, 59 Des Voeux Road Central, Hong Kong 香港德輔道中59號中南行5樓 予本公司之「資料保障主任」作出有關要求，本公司將停止使用其個人資料作該有關用途。
Under the Ordinance, even if a customer has consented to the Company using and/or transferring his/her personal data to Third Parties for direct marketing, the customer still has the right, at any time and without charge, to require the Company to cease using and/or transferring his/her personal data to Third Parties for direct marketing. Customers may make such a request in writing to the Company’s Data Protection Officer at info@mortgageology.com.hk or at 5/F, Chung Nam House, 59 Des Voeux Road Central, Hong Kong 香港德輔道中59號中南行5樓, and the Company will cease using the personal data for such purpose.
8. 個人資料的保安及保存 Security and Retention of Personal Data
本公司已實施內部監控措施，確保個人資料的保安，以防止個人資料在未經授權或意外的情況下被查閱、處理、刪除、喪失或使用。根據本公司內部守則保存顧客的個人資料期限為7年，或為按照適用法律、規則及規例以及由監管機構（包括但不限於地產代理監管局）所發出並適用於本公司的指引、執業通告、操守守則及執業指引所規定的較長期限。
The Company has implemented internal control measures to ensure the security of personal data and to prevent personal data from being accessed, processed, erased, lost or used in an unauthorised or accidental manner. Under the Company’s internal guidelines, customers’ personal data is retained for a period of 7 years, or such longer period as may be required by applicable laws, rules and regulations and by the guidelines, practice circulars, codes of conduct and practice directions issued by regulatory bodies (including but not limited to the Estate Agents Authority) applicable to the Company.
9. 查閱及改正個人資料 Access to and Correction of Personal Data
根據該條例，顧客有權查閱及／或改正其個人資料。據此，顧客可隨時致函 info@mortgageology.com.hk 或 5/F, Chung Nam House, 59 Des Voeux Road Central, Hong Kong 香港德輔道中59號中南行5樓 予本公司之「資料保障主任」。根據該條例，本公司有權就處理顧客查閱其個人資料的要求收取合理的費用。
Under the Ordinance, customers have the right to access and/or correct their personal data. Accordingly, customers may at any time write to the Company’s Data Protection Officer at info@mortgageology.com.hk or at 5/F, Chung Nam House, 59 Des Voeux Road Central, Hong Kong 香港德輔道中59號中南行5樓. Under the Ordinance, the Company is entitled to charge a reasonable fee for processing a customer’s data access request.

When you sign the Mortgage Referral Application Form via an e-signing link issued by us, documents are generated at the moment of signing and delivered by email; our web servers do not retain your personal data. Data embedded in the signing link is encrypted and the link expires automatically after seven days, and document attachments sent to you are password-protected. Such data may be processed on servers located outside Hong Kong.
